TERMS OF SERVICE & LEGAL

Please read these terms carefully before using this website or purchasing from Deerfield Cutlery.

Part A — Using This Website

1. Acceptance of These Terms

These Terms of Service are an agreement between you and Deerfield Cutlery (“DFC,” “we,” “us,” or “our”) governing your access to and use of deerfieldcutlery.com, including all content and functionality on it and any online store offered through it (the “Website”).

By using the Website, you accept and agree to be bound by these Terms of Service and our Privacy Policy (Section 16). If you do not agree, you must not access or use the Website. By using the Website, you confirm that you are the legal age of majority in your jurisdiction to form a binding contract with us, and that if you access the Website from a jurisdiction where doing so is not permitted, you do so at your own risk.

2. Changes to These Terms

We may revise these Terms of Service at any time. Changes are effective as soon as they are posted. Continuing to use the Website after a change means you accept the revised terms.

3. Your Responsibilities

You are responsible for making sure any information you provide us — including at checkout — is accurate, current, and complete. You are solely responsible for your own use of the Website, your device, and your internet and data security.

4. Prohibited Activities

You may use the Website only for lawful purposes. You agree not to:

  • Use the Website in any way that violates any applicable federal, state, or local law or regulation.
  • Use the Website to exploit, harm, or attempt to exploit or harm a minor in any way.
  • Send spam, chain letters, or other unsolicited advertising through the Website.
  • Impersonate DFC, a DFC employee, or any other person or entity.
  • Use a robot, spider, scraper, or other automated means to access or copy the Website without our written permission.
  • Introduce a virus, malware, or other harmful code, or attempt to disrupt or gain unauthorized access to the Website, its server, or any connected database.
  • Attack the Website with a denial-of-service attack or otherwise interfere with its proper operation.

5. Our Rights

Without needing to notify you first, we have the right to:

  • Take appropriate legal action, including referral to or cooperation with law enforcement or regulatory authorities, in response to any illegal or unauthorized use of the Website — including anything prohibited under Section 4.
  • Terminate or suspend your access to all or part of the Website for any reason, or no reason, including any violation of these Terms of Service.

You waive and hold DFC and its officers, employees, agents, service providers, contractors, and successors harmless from any claim resulting from any action we take under this section, including cooperating with or referring a matter to law enforcement.

6. Intellectual Property Rights

Everything on this Website — including its text, photos, product descriptions, design, and the Deerfield Cutlery name and logo — is owned by DFC or its licensors and is protected by copyright, trademark, and other intellectual property law. You may view, print, or download a reasonable number of pages for your own personal, non-commercial use. You may not reproduce, redistribute, modify, or republish any of it, or remove any copyright or trademark notice, without our written permission.

7. Third-Party Links & Content

This Website may link to third-party sites — for example, the brands we carry or the shows we attend. We do not control those sites and are not responsible for their content, accuracy, or availability. Visiting a linked site is at your own risk and subject to that site’s own terms.

Part B — Buying Knives From Us

8. Knife Sale Agreement

Eligibility & Age Requirement

You must be at least 18 years of age to purchase any cutlery, edged tool, or accessory from Deerfield Cutlery. Age is verified at checkout through a third-party age verification service; orders that fail age verification will not be processed.

Automatic Knife Compliance

Deerfield Cutlery currently offers two automatic knives: the Buck 110 Auto (3.75″ blade) and the Buck 112 Auto Ranger (3″ blade). See Section 9 for what “automatic knife” means and Section 10 for the states where we cannot ship them.

Automatic knife laws vary by state, and it is the buyer’s responsibility to know and comply with the laws of their own state and locality before purchasing. Deerfield Cutlery will automatically cancel the automatic-knife item on any order shipping to a restricted state. The remainder of the order — any non-automatic items — will still be processed and shipped normally. See Section 13 for how that cancellation is refunded.

Assumption of Risk / Indemnification

By purchasing from Deerfield Cutlery, the buyer agrees to assume all risk associated with the use, misuse, storage, or possession of any tool purchased, and to hold Deerfield Cutlery harmless from any injury, death, property damage, or legal consequence resulting from that use, misuse, storage, or possession. (This is separate from — and in addition to — the general Website liability terms in Section 15.)

9. Definitions

Deerfield Cutlery uses “automatic knife” and “switchblade” interchangeably in this document to mean the same thing: a knife with a blade that opens automatically by hand pressure applied to a button, spring, or other device in the handle. This is the definition used in the federal Switchblade Act and in every state statute cited in Section 10. Most state statutes use the word “switchblade”; the knife trade — including Buck’s own product names — commonly says “automatic knife.” Neither of our two automatic models is an out-the-front (OTF) knife; both are side-opening.

For clarity, and because state laws sometimes treat these differently, here is what Deerfield Cutlery does not sell:

  • Out-the-front (OTF) automatic knives — the blade travels straight out the front of the handle rather than pivoting open from the side. Legally still an automatic knife/switchblade under the definition above; we simply do not carry this style.
  • Gravity knives — a blade that opens by the force of gravity, an outward thrust, or centrifugal force rather than a button. Several of the statutes in Section 10 capture gravity knives under the same restriction as button-actuated automatics; we do not sell this type at all.
  • Balisong / butterfly knives — a blade housed in a split handle, opened by manually manipulating the two handle halves. Not an automatic knife under the definition above, but separately restricted in some states; we do notsell this type at all.

If we add another automatic model to inventory in the future, this section and the table in Section 10 will be revisited before it goes live for sale.

10. Automatic Knife — State Restrictions

This section applies specifically to our two current automatic models — the Buck 110 Auto (3.75″ blade) and the Buck 112 Auto Ranger (3″ blade). Every citation below is linked to its source in Section 19.

States where we cannot sell or ship an automatic knife

State Restriction Effect on Our Automatic Knives
California Cal. Penal Code §21510 makes it a misdemeanor to possess, carry, sell, offer for sale, or transfer a switchblade with a blade of 2″ or more. Both models exceed 2″ — order canceled.
Connecticut Conn. Gen. Stat. §53-206 caps the legal blade length for an automatic/switchblade-type knife at 1.5″; carrying anything longer is a Class D felony. Both models exceed 1.5″ — order canceled.
District of Columbia D.C. Code §22-4514 makes possession of a switchblade unlawful, with no exception for general retail sale. Independently reconfirmed directly against the official DC Code text. Order canceled.
Maryland Md. Code, Crim. Law §4-105 makes it unlawful to sell, barter, display, or offer to sell a switchblade knife. Possession and open carry are not separately restricted, but we cannot lawfully sell into this state. Order canceled.
Minnesota Minn. Stat. §609.66, subd. 1(a)(4) makes it unlawful to manufacture, transfer, or possess a switchblade knife that opens automatically. Order canceled.
New Jersey N.J. Stat. §2C:39-9(d) prohibits the manufacture, sale, or transport of switchblade knives outright. §2C:39-3(e) separately prohibits possession without an explainable lawful purpose. Order canceled.
New Mexico N.M. Stat. §30-7-8 makes it unlawful to manufacture, possess, sell, lend, give away, or purchase a knife that opens automatically by hand pressure, or by gravity or centrifugal force. Order canceled.
New York Switchblade possession/sale is a criminal offense under Penal Law §265.01. Exemptions (§265.20) cover only law enforcement, military, and licensed hunters, trappers, and anglers — not general retail sale. Independently reconfirmed against NY’s own current statute text. Order canceled.
Washington RCW 9.41.250 prohibits the manufacture and sale of a “spring blade knife” — any knife whose blade is released automatically by a spring or mechanical device, or by gravity, an outward thrust, or centrifugal force. Order canceled.

States with a knife-specific rule that does not block the sale

State What the Law Actually Restricts Effect on Our Automatic Knives
Hawaii Haw. Rev. Stat. §134-52 was narrowed by 2024 Act 21 (House Bill 2342) from a full possession ban down to prohibiting concealed carry only. Hawaii’s own codified-statute lookup site has not yet been updated to show this amendment — see Section 19 for both the base section and the Act 21 record. Order allowed — buyer-awareness note only.
Kentucky KRS §237.109 requires a carrier to be 21 or older to carry a concealed deadly weapon without a permit. This governs concealed carry, not purchase or possession — Kentucky sets no minimum age to possess a knife. Order allowed — buyer-awareness note only.

States not listed in either table above currently have no automatic-knife-specific restriction on sale, possession, or purchase age beyond the standard 18-and-over cutlery requirement in Section 8.

11. Online Orders & Payment

Placing an order is an offer to buy at the price shown in your cart at checkout. We are not obligated to accept any order and may decline or cancel one at our discretion, even after sending an order confirmation.

Prices, availability, and promotions are subject to change without notice; a price change applies only to orders placed after the change. Posted prices do not include sales tax or shipping and handling — both will be itemized in your cart and order confirmation. We work to keep pricing accurate, but if a typographical error or pricing mistake occurs, we reserve the right to correct it and to cancel any order affected by it. If we cancel an order for this reason, you will be notified and refunded in full for the affected item.

Deerfield Cutlery is not currently accepting payments via the website. This will be updated when payments are able to be accepted.

12. Shipping & Compliance Policy

Domestic Shipping Only

We do not ship any products outside the United States. Orders with an international billing or shipping address will be automatically canceled.

Automatic Knife Shipping

Under the Federal Switchblade Act (15 U.S.C. §§1241–1245) and 18 U.S.C. §1716(g) (which classifies automatic knives as nonmailable matter), automatic knives cannot be shipped via the United States Postal Service. All automatic knife orders ship exclusively via UPS or FedEx ground service.

Because UPS and FedEx generally cannot deliver to PO Boxes or APO/FPO military addresses, we are unable to ship automatic knives to those address types. Orders shipping to a restricted state (Section 10) will have the automatic knife item automatically removed from the order; the rest of the order ships normally.

Flammable Liquids — Zippo Fuel, Flints & Wicks

Lighter fluid cannot be shipped by air. Any order containing our Zippo fuel kit will ship via ground service only (USPS Ground Advantage or UPS/FedEx Ground) in compliance with DOT hazardous materials (HAZMAT) shipping regulations. Flints and wicks ordered as part of the same kit ship under the same ground-only rule.

13. Returns & Refunds

All sales are final. Deerfield Cutlery does not accept returns or issue refunds, with one exception.

The exception: if your order includes an automatic knife that gets canceled under Section 8 or Section 10 because it is shipping to a restricted state, that item is refunded automatically to your original payment method. You do not need to request anything — the refund is processed as part of handling your order, and the rest of your order ships normally.

14. Product Disclaimers

No Tactical Weapons

Deerfield Cutlery outfits the field, the pocket, and the home. We do not sell tactical weapons, combat knives, or military-grade weaponry.

Trademark & Brand Disclaimer

Deerfield Cutlery is an independent, authorized retailer of 100% factory-original cutlery and accessories. We currently carry the following brands:

All brand names, logos, and trademarks are the property of their respective owners. Deerfield Cutlery is not affiliated with, endorsed by, or an official representative of any brand listed above beyond an authorized independent retailer relationship.

Part C — General Legal Terms

15. Disclaimers, Limitation of Liability & Indemnification

This section covers use of the Website generally — for knife-specific risk and indemnification terms, see Section 8.

The Website and everything on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, except where such a disclaimer is not permitted by law. We do not warrant that the Website will be accurate, reliable, uninterrupted, or free of errors or harmful components.

To the fullest extent permitted by law, DFC will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Website or any purchase made through it, regardless of the legal theory, even if we have been advised of the possibility of such damages.

You agree to defend, indemnify, and hold DFC harmless from any claim, liability, damage, loss, or expense (including reasonable attorneys’ fees) arising from your breach of these Terms or your use of the Website, except to the extent it results from our own negligence or willful misconduct.

16. Privacy Policy

Your provision of personal information through the Website is governed by our Privacy Policy, incorporated here by reference.

17. Governing Law

These Terms of Service and the Website are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Website will be brought exclusively in the state or federal courts located in North Carolina, and you consent to the jurisdiction and venue of those courts.

18. General Provisions

Severability

If any part of these Terms is found unenforceable, the rest will remain in full effect, and the unenforceable part will be replaced with language that most closely reflects its original intent.

Entire Agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and DFC regarding the Website and replace any prior agreements on the subject.

Waiver

Our failure to enforce any part of these Terms is not a waiver of our right to do so later.

Notice

We may notify you under these Terms by emailing the address you have given us or by posting notice on the Website. It’s your responsibility to keep your email address current.
